PIC has been a leading adviser on Vietnam’s energy transition and clean energy sector since 2018.

The firm has a deep knowledge of the Vietnamese legal and regulatory environment and has advised extensively on renewable energy power project development in the country. PIC has advised on some of the country’s first and largest offshore wind projects and is a leading adviser to international sponsors and investors on Vietnam’s power sector.

Key experience – Vietnam energy policy

  • Advising the Global Wind Energy Council (GWEC) on development of a competitive selection mechanism for Vietnam’s offshore wind sector and the related policy and regulatory framework.​​

  • Advising the Asian Development Bank (ADB) on developing the legal and regulatory framework for energy service companies in Vietnam. Including extensive engagement with the Ministry of Industry and Trade (MOIT) and Vietnam Electricity (EVN).

  • Advising the United Nations Development Programme (UNDP) on the policy, legal, regulatory and governance framework with respect to Vietnam’s energy transition and specifically its policy with respect to coal fired power plants. Including engagement with EVN, MOIT and private sector coal investors over 6 months.​

  • Advising the UK Government (Foreign, Commonwealth and Development Office) with respect to a technical assistance programme on the legal, policy and regulatory framework in Vietnam with respect to private sector development and operation of the transmission grid.

  • Advising a Korean energy company on Vietnam's climate change policy, national power planning and policy with respect to carbon emissions reduction. This report specifically analysed coal abatement and policy impacting the early decommissioning of coal thermal power plants.

  • Advising a US based oil and gas company on Vietnamese renewable energy policy, regulation and planning.​

  • Advising a Chinese infrastructure fund on Vietnamese renewable energy policy, tariff policy, regulation and planning.=​

  • Advising an international wind and renewable energy developer on Vietnamese energy policy, offshore wind policy and regulation and government engagement.

Experience and Capability

Vietnam clean energy project development

  • Advising a UK developer with respect to the development of an offshore wind farm in Binh Thuan province, including advising on structuring, bankability, energy policy, power project licensing and regulation.​

  • Advising an international offshore wind developer with respect to the development of offshore wind projects in the North and South of Vietnam.

  • Advising a US private equity firm on investment into and development of a platform of solar and nearshore wind participation via convertible bond financing.​

  • Advising a renewable energy developer on Vietnam’s transmission grid, power market deregulation and strategic investment in a BESS and micro grid development project.​

  • Acting for a Vietnamese renewable energy company in respect of strategic investment into an offshore wind project in the south of Vietnam including advising on the regulatory framework with respect to renewable energy project development in Vietnam.

  • Advising a Vietnamese clean energy company in respect of strategic foreign investment and project development for a 1500 MW LNG project in the north of Vietnam.

  • Acting for a Hong Kong based infrastructure fund in respect of the acquisition of a 100 MW solar project in Dak Nong province.​

  • Acting for the seller in respect of the sale of a 260 MW solar project in the south of Vietnam.​

  • Advising a Vietnamese wind developer on the sale of three onshore wind projects totaling 570 MW.

  • Acting for a Vietnamese renewable energy developer on the sale of an 8MW solar rooftop platform in Long An province.

  • Acting for a Vietnam based renewable energy company in respect of strategic investment into a 2 GW offshore wind project in Tra Vinh province.

Experience and Capability

Working with the Vietnamese Government

With extensive experience and a close working relationship with government authorities and state-owned enterprises, PIC has an in-depth knowledge of the working practices and requirements of Vietnam’s public sector.

Both international investors and lenders value PIC’s capacity to determine project frameworks and structures as well as coordinating negotiation and managing approval processes.

PIC’s team brings the experience of having advised on major power and infrastructure projects such as Phu My 2.2 BOT Power Project, Vinh Tan 1 BOT Power Project and most recently, Nghi Son 2 BOT Power Project, Van Phong 1 BOT Power Project and the refinancing of Mong Duong 2 BOT Power Project. Experience in these projects demonstrates the team’s expertise in negotiation and cooperation with Vietnamese government authorities and counterparties.

 

In addition, PIC has contributed to advising development partners, international donors and government authorities on draft legislation. This has further strengthened and consolidated the good working relationship and cooperation between PIC and government authorities at both a provincial and national level.
